Terms of service.
The short version: don’t use SendTidings to spam, break the law, or harm your clients. We’ll do our best to keep the service running and your data safe. Either of us can walk away with reasonable notice.
1. Who’s who
“SendTidings”, “we”, “us” and “our” mean Prystine Web Solutions Ltd, a company registered in England and Wales (Company No. 12513859, VAT No. GB421674703) with its registered office at 23 Barberry Drive, Didcot, OX11 6JY. SendTidings is a trading name of Prystine Web Solutions Ltd.
“You” means the person or business with a SendTidings account. By creating an account or using the service, you agree to these terms.
2. The service
SendTidings is a software-as-a-service tool that pulls data from your connected analytics sources, renders monthly reports, and emails them to recipients you specify. We provide it on an “as is” basis. We aim for high uptime but do not promise the service will be uninterrupted or error-free.
3. Your account
You must be at least 18 years old and acting on behalf of a legitimate business to create an account. You’re responsible for keeping your login credentials secret and for everything that happens under your account. Tell us straight away if you think someone else has access to it.
4. Acceptable use
You agree not to use SendTidings to:
- send unsolicited bulk email or anything that would qualify as spam;
- send content that is illegal, defamatory, or harasses anyone;
- impersonate someone else or misrepresent who the report is from;
- attempt to break, probe, or overload our infrastructure (security researchers acting in good faith are exempt; please email us first);
- resell or sublicense the service without a written agreement.
5. Recipient consent and your clients’ data
You confirm that every report recipient you add to SendTidings has either consented to receive emails from you, or has another lawful basis for receiving them (for example, an existing client relationship where the report is part of the service you provide). We process your clients’ data on your instructions as a data processor; a data-processing addendum is available on request to privacy@sendtidings.com.
6. Subscriptions and payment
Paid plans are billed monthly in advance through our payments partner, Paddle (Paddle.com Market Limited). Paddle is the Merchant of Record for SendTidings: when you buy a subscription, the payment relationship is technically with Paddle, who then provides the software service to you on our behalf and handles invoicing and any sales tax / VAT in your jurisdiction. Paddle’s checkout buyer terms apply to the payment itself; these SendTidings terms govern your use of the software.
Subscriptions auto-renew at the end of each billing period unless you cancel. Prices on the pricing page are exclusive of VAT, which is added at checkout where required. If a payment fails, Paddle will retry a few times and we’ll give you reasonable warning before downgrading the account.
7. Refunds
We offer a 14-day, no-questions-asked refund on your first paid subscription. Full details and the request process are on the Refund Policy page.
8. Free tier
The free tier is genuinely free for one site. We may add or change limits but we’ll never quietly start charging for a feature that was free when you signed up — if a free feature becomes paid, you’ll be notified and given a fair window to decide.
9. Cancellation
You can cancel any time from within the app. Cancelling stops future charges immediately and the account stays active until the end of the current billing period. Outside the 14-day window in section 7, we don’t prorate refunds for partial months unless required by law. Your data is exportable for up to thirty days after cancellation.
10. Suspension
We may suspend or close an account that breaks these terms, in particular the acceptable-use rules in section 4. Where it’s safe to do so we will warn you first; for serious abuse (spam, fraud, illegal content) we may suspend immediately.
11. Intellectual property
We own the SendTidings software, brand, and platform. You own the content you upload (your branding, your client list, your report copy). You grant us the licence we need to run the service for you: essentially, “the right to render your reports and email them to the recipients you specify.” Nothing in these terms transfers ownership of your or your clients’ intellectual property.
A self-hostable open-source build of SendTidings is planned under the AGPL-3.0 licence. Different terms apply when you self-host; this policy only covers the hosted service at sendtidings.com.
12. Liability
To the maximum extent allowed by law, our total liability to you for any claim relating to the service is limited to the amount you have paid us in the twelve months immediately before the claim. We’re not liable for indirect or consequential losses (lost profits, lost goodwill, lost data beyond our backups). Nothing in these terms limits liability for fraud, gross negligence, death or personal injury caused by negligence, or anything else that can’t be limited under applicable law.
13. Changes to these terms
We may update these terms from time to time. If a change is material we’ll email account holders before it takes effect. Continued use of the service after the change date counts as acceptance.
14. Governing law
These terms are governed by the laws of England and Wales. Disputes will be heard in the courts of England and Wales unless you have a legal right to bring proceedings somewhere else as a consumer.
